General Terms and Conditions (GTC) for the end consumer mail order business of KRONSEGLER GmbH, Hauptstrasse 19, 01768 Glashütte/Sa., HRB 22934, UID DE 1814129034,

General

The following terms and conditions apply to all contracts, deliveries, and other services within the scope of our mail order business. We hereby expressly object to any deviating provisions of the contractual partner. KRONSEGLER reserves the right to restrict, change, and/or discontinue the online service and mail order business. KRONSEGLER reserves the right to change the General Terms and Conditions in whole or in part. Changes to the General Terms and Conditions apply to contracts concluded after the new General Terms and Conditions have been published in the online shop.

Offer

All prices quoted are in euros (EUR) and include statutory value added tax for customers within the European Union. All offers are valid while stocks last. We expressly reserve the right to make printing errors, design and technical changes to our illustrations or descriptions. The RRP price quoted for some products is a completely non-binding recommended retail price. The non-binding recommended retail price (RRP), also known as the non-binding sales price (UVP) or recommended sales price, is the price that the manufacturer recommends to retailers as a non-binding resale price to customers. It is intended to serve as a price guide for sales and as a calculation aid for retailers. The RRP is determined by comparing products from other market participants that offer similar features, quality, functionality, origin, and services. The RRP may be exceeded or fallen short of on the market.

Conclusion of contract

  1. The presentation of goods and services in our online shop does not constitute a legally binding offer, but merely an invitation to place an order (invitatio ad offerendum).
  2. By clicking on the “BUY NOW” button in the last step of the ordering process or by clicking on the corresponding forwarding button to PayPal, you are submitting a binding offer to conclude a purchase contract for the goods displayed in the order overview.

Immediately after submitting your order, you will receive an automatic order confirmation documenting the receipt of your order, but this does not yet constitute acceptance of your contractual offer.

A contract is only concluded when we accept your offer by sending a separate declaration of acceptance by email or by shipping the goods. Please check the spam folder of your email inbox regularly. We reserve the right not to accept orders.

  1. You can select goods in our online shop by placing them in the shopping cart using the corresponding button. You can change the desired quantity or remove selected goods from the shopping cart at any time. Once you have placed your goods in the shopping cart, clicking on the “CHECKOUT” button will take you to a page where you can enter your details, select the payment method and, depending on the amount to be paid and the shipping address, the shipping method. Please check your details and correct any input errors. If you wish to cancel the order process, you can leave it at any time by closing your browser window. Only by subsequently clicking on the “BUY NOW” button or the corresponding forwarding button to PayPal do you submit a binding offer within the meaning of paragraph 2. Until this point, you can correct your entries or withdraw from the order process.

Payment terms:

The following payment methods are available in our online shop:

Prepayment (direct bank transfer)

If you choose prepayment as your payment method, the purchase price must be paid by bank transfer before the goods are shipped. The delivery period begins after receipt of payment. The bank details will be provided to the customer in the order confirmation.

PayPal

If you select PayPal as your payment method, payment will be processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg (see https://www.paypal.com/de/home). In order to pay the invoice amount via PayPal, the customer must be registered there or first register, authenticate with their access data, and confirm the payment instruction to us. An exception is credit card payment via PayPal, for which no PayPal account is necessary.

Depending on their PayPal settings, customers can pay

  • with their PayPal balance,
  • by direct debit,
  • by credit card,
  • or using the installment payment or “pay later” options offered by PayPal.

Payment is triggered immediately after the order is completed.

Credit card payment (via PayPal – no PayPal account required)

Credit card payments are processed via the payment service provider PayPal, even if the customer does not have a PayPal account. If this payment method is selected, the purchase price will be charged to the customer’s credit card when the order is completed.

PayPal installment payment/pay later

If set up by the customer with PayPal and available for the respective purchase, payment can also be made via installment payment or later payment options offered by PayPal.

The contractual terms and conditions for this are agreed directly between the customer and PayPal.

The seller receives the purchase price regardless of the selected PayPal payment option in accordance with the PayPal terms and conditions.

Delivery and shipping conditions

Shipping area

Delivery is made to delivery addresses within Germany and, where offered, to selected countries outside Germany.

Shipping conditions within Germany:

Delivery is made to the delivery address you specify within Germany by a shipping service provider of our choice.

The respective shipping costs and the estimated delivery time are displayed in the shopping cart after entering the delivery address and are also summarized on a separate shipping information page.

Unless otherwise stated, the delivery period begins for prepayment on the day of receipt of payment, for all other payment methods on the day of conclusion of the contract.

Shipping conditions abroad:

Delivery will be made to the delivery address specified by the customer by a shipping service provider of our choice. The shipping costs and delivery time are displayed in the shopping cart after entering the delivery address and can also be found summarized on a separate shipping information page.

For deliveries outside the European Union, the invoice will be issued for the net value of the goods (excluding VAT/sales tax). Upon import into the destination country, the goods are subject to import sales tax and, in some cases, customs duties and customs processing fees, which must be paid locally by the customer.

Right of withdrawal

Consumers who have their habitual residence in a member state of the European Union are generally entitled to a right of withdrawal. Consumers outside the EU do not have a right of withdrawal.

Details on the right of withdrawal, in particular on the conditions, deadlines, and legal consequences of withdrawal, can be found in the separate cancellation policy, which is also made available to the customer during the ordering process and is linked in the footer of the online shop.

Warranty

Consumers are entitled to statutory warranty rights. The warranty period is 24 months from delivery of the goods.

Retention of title

The goods remain the property of KRONSEGLER until full payment has been received.

Optional insurance ‘Uhrenschutz KOMFORT Wertgarantie’

The optional KRONSEGLER insurance (‘Uhrenschutz KOMFORT Wertgarantie’) is available only to customers residing in Germany.

If you take out “Uhrenschutz KOMFORT Wertgarantie” as an additional service for your ordered watch in our online shop, a separate contract will be concluded between you and the insurance provider WERTGARANTIE SE, Breite Straße 8, 30159 Hanover. We act as an intermediary in this case.

The personal data required for the insurance contract will be transferred to WERTGARANTIE SE for processing. For more information on data processing, please refer to the privacy policy of WERTGARANTIE SE.

You will receive the contract documents (in particular the insurance policy, contract terms and conditions, cancellation policy, and general insurance conditions) directly from WERTGARANTIE SE by email.

If you effectively revoke the purchase contract for the insured watch, the insurance contract concluded at the same time will also end.

The insurance contract can also be revoked independently of the purchase contract within the statutory revocation period vis-à-vis WERTGARANTIE SE.

Terms and conditions for voucher promotions, gifts, and competitions

KRONSEGLER vouchers are valid for our own product range, i.e., for goods and services sold by KRONSEGLER itself via its online shop. Misuse of the promotions (e.g., commercial distribution of product tip and address lists) is prohibited. Gifts with partner products will only be issued once the underlying order has been successfully completed with the product partner. Any watch models presented as gifts will be replaced by us with models of at least equal value should they no longer be available.

Miscellaneous

With the exception of cases required by law, KRONSEGLER accepts no liability for damages arising from the use of the content provided or other offers in our online shop. This applies in particular to indirect damages or lost profits.

KRONSEGLER makes every reasonable effort to provide accurate and complete information on its websites. However, KRONSEGLER does not guarantee that the content is up to date, correct, or complete. KRONSEGLER is not responsible for the content of external websites to which links are provided and is not liable for any direct or indirect damage, including loss of profit, arising from information provided on these websites.

The content of our websites is protected by copyright. The storage and reproduction of images or graphics from our websites is not permitted without our express consent. All legal relationships arising from the terms of use for the parties are governed by the laws of the Federal Republic of Germany. The place of jurisdiction and place of performance in commercial legal transactions is Glashütte. Should individual passages of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining content or the General Terms and Conditions as such.
